Bay Club Condominium Lawsuit To Continue

Upscale condo in legal tangle with former counsel

A luxury Bayside condominium has been given the green light by a Queens court to sue its former law firm.  The firm, Borah, Goldstein, Altschuler, Schwartz & Nahins, P.C., specializes in landlord/tenant suits. 

The Bay Club condominium's lawsuit charges that its former counsel committed legal malpractice in preparing a foreclosure action.

The firm was retained to prepare and file a lien against one of the condominium owners for unpaid common charges.

The suit alleges that the firm was negligent in drafting and filing a notice of lien.  The lawsuit alleged that as a result of this negligence the condominium association sustained damages by requiring it to incur more litigation expenses in defending the validity of the lien.

Bay Club is a doorman building high-rise with two imposing wings.  It boasts of thirteen acres in a park setting with gated security and a swim and fitness center.  Many of the apartments have balconies and water views.

Borah, Goldstein specializes in representing landlords of both residential and commercial units.  Its Web site bills the firm as a leader in the prosecution of summary non-payment and holdover proceedings. It has a staff of 36, according to Judged.com, with offices in Forest Hills and in Manhattan.

The decision by Judge Charles J. Markey of Queens Supreme Court denied the defendant's motion to dismiss the complaint. As a result, the lawsuit can continue towards trial.

Neither the firm nor the Bay Club could comment immediately on the suit. Bayside Patch awaits statements from both parties.
